These Terms of Service ("Terms") govern your use of the Biodynamic Therapies website and your relationship with Biodynamic Therapies ("the Clinic", "we", "us") when you book or receive services at 155 Frobisher Dr, Unit G 113, Waterloo, Ontario. By using our website, submitting a request or attending an appointment, you agree to these Terms. Please read them together with our Privacy Policy.
1. Our services
The Clinic offers osteopathic manual therapy, Traditional Chinese Medicine and acupuncture, registered massage therapy, and technology-assisted treatments including focal shockwave, radial pressure wave, Class IV laser and extracorporeal magnetotransduction (EMTT) therapy. Services are provided by Christian Pinnau, R.TCMP, R.Ac, DOMP, RMT, and any associated practitioners, each within the scope of their training and, where applicable, their regulatory college.
Acupuncture, Traditional Chinese Medicine and massage therapy are regulated health professions in Ontario. Osteopathic manual practice is not currently a regulated profession in Ontario; our osteopathic manual practitioner holds a Diploma in Osteopathic Manual Practice (DOMP) and is not a physician or a doctor of osteopathic medicine.
2. Not medical advice; no emergency care
Information on this website is provided for general education and is not medical advice, diagnosis or treatment. It does not create a practitioner-patient relationship. Results described on the website or in our social media are not guaranteed and vary from person to person. Always consult a physician or qualified health professional about your condition, and do not delay seeking medical care because of something you read here.
The Clinic does not provide emergency services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.
3. Informed consent and your responsibilities
Before treatment begins we will explain the nature of the proposed treatment, its expected benefits, material risks and side effects, alternatives and the likely consequences of not having treatment, and we will answer your questions. Treatment proceeds only with your informed consent, which you may withdraw at any time. For minors or people unable to consent, we require consent from a parent, guardian or substitute decision-maker.
You agree to provide accurate and complete health information, including medications, implants such as pacemakers, pregnancy, and any changes to your health, so that we can decide whether a treatment is safe for you. Some technologies, including EMTT and shockwave, are not suitable for everyone and may be declined at our professional discretion.
4. Appointments, cancellations and no-shows
Appointment requests made through our website or by phone are confirmed by us by phone or email; a request is not a confirmed booking until you hear from us. We ask for at least 24 hours' notice to cancel or reschedule. Late cancellations and missed appointments may be charged a fee of up to the full cost of the booked service, at the Clinic's discretion. Arriving late may shorten your treatment time so that other patients are not delayed.
5. Fees, payment and insurance
We operate on a fee-for-service basis. Current fees are available at the clinic and may change with notice. Payment is due at the time of service, and we accept cash, cheque, debit, e-transfer, Visa and Mastercard. We do not direct-bill insurers; after each appointment you receive a detailed receipt that you may submit to your extended health plan. Coverage depends on your plan, and you are responsible for confirming eligibility with your insurer and for any amounts not reimbursed. Where applicable, fees are subject to HST.
6. Clinic conduct
To keep the clinic safe and welcoming, we ask that you treat staff and other patients with respect. Abusive, harassing or inappropriate behaviour, or attending while impaired, may result in treatment being refused or ended and the appointment being charged. Practitioners may also decline or discontinue treatment where it is not clinically appropriate, and will refer you to other care where possible.
7. Privacy
Your personal and personal health information is handled in accordance with Ontario's Personal Health Information Protection Act and our Privacy Policy, which forms part of these Terms.
8. Use of the website
You may use this website for lawful, personal purposes. You agree not to interfere with its operation, attempt to gain unauthorized access, submit false or misleading information, or use automated tools to copy its content. We may suspend or restrict access to anyone who breaches these Terms.
The website content, including text, photographs, video, logos and design, is owned by or licensed to Biodynamic Therapies and protected by Canadian and international copyright and trademark law. You may not reproduce or distribute it without our written permission, except for personal, non-commercial viewing.
9. Third-party content and links
Our website embeds and links to third-party services such as Google Maps and Instagram. We do not control those services and are not responsible for their content, availability or privacy practices. Treatment technology brand names mentioned on the site belong to their respective owners.
10. Electronic communications
By providing your email address or phone number you consent to receive appointment confirmations, reminders and messages about your care. Marketing messages are sent only with your express consent in accordance with Canada's Anti-Spam Legislation, and you may unsubscribe at any time. Email and text are not fully secure; please do not send detailed health information through web forms, email or text.
11. Disclaimer of warranties and limitation of liability
The website is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness or uninterrupted availability. To the fullest extent permitted by law, the Clinic and its practitioners, employees and contractors are not liable for any indirect, incidental, special or consequential damages arising from your use of the website or reliance on its content.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Ontario law, including liability for professional negligence in the delivery of care, or your rights under the Ontario Consumer Protection Act, 2002.
12. Accessibility
Our clinic is fully wheelchair accessible with free on-site parking and no stairs. We are committed to meeting the Accessibility for Ontarians with Disabilities Act standards, welcome service animals and support persons, and will provide accommodation or information in an accessible format on request. Please contact us if you have accessibility needs or feedback.
13. Complaints
If you are unhappy with any aspect of your care, please tell us so we can put it right. You may also contact the practitioner's regulatory college: the College of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario (ctcmpao.on.ca) for acupuncture and TCM, or the College of Massage Therapists of Ontario (cmto.com) for massage therapy.
14. Governing law and changes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, and any dispute will be resolved in the courts of Ontario. If any provision is found unenforceable, the remaining provisions continue in effect. We may update these Terms at any time by posting a revised version with a new "last updated" date; continued use of the website or our services after a change means you accept the revised Terms.
